Messrs Noor Flour Mills v Judge Banking Court,

CLD 2011 1263 · Balochistan High Court

This case involved a bank recovery suit under the Financial Institutions (Recovery of Finances) Ordinance, 2001. A bank had sued a flour mill and its guarantor for recovery of a loan, claiming they defaulted on repayment after availing financing facilities. The defendants applied for leave to defend the suit, raising various factual and legal objections and submitting supporting documents. However, the Banking Court in Quetta dismissed their application without properly examining these objections or the documents, and went ahead to decree the suit in the bank's favor for a substantial amount.

The defendants appealed to the Balochistan High Court, arguing that the Banking Court's judgment was inadequate. The High Court agreed, holding that a proper judgment must clearly state the case, identify the points for determination, and give reasoned decisions on each issue - especially in commercial disputes where documents defining the parties' rights and obligations must be carefully considered. The Court found that the Banking Court's order was not a "speaking judgment" because it failed to address the legal and factual arguments raised by the defendants or discuss the documents they filed.

As a result, the High Court set aside the judgment and decree, and sent the case back to the Banking Court to properly decide the leave-to-defend application. This case matters because it reinforces that courts, especially specialized tribunals handling fast-track commercial disputes, must still provide reasoned, well-considered judgments rather than brief, unexplained rulings - ensuring fairness even in expedited recovery proceedings.
