Mir Shams Ud Din V. Mir Zia Ud Din and 5 others,

CLC 2025 130 · Balochistan High Court

This case involved a family property dispute between Mir Shams Ud Din and Mir Zia Ud Din, with two connected civil suits pending before a Senior Civil Judge in Quetta. During the proceedings, the petitioner, Shams Ud Din, asked for both suits to be transferred away from the trial judge, claiming the judge was biased against him. His main evidence was that the opposing side had allegedly said they would get a favourable outcome from that particular court. The appellate court (District Judge) rejected this transfer request, and Shams Ud Din then challenged that rejection before the Balochistan High Court.

The High Court upheld the lower court's decision and dismissed the petition. Relying on a Supreme Court precedent, it explained that bias can take different forms, such as a judge having a personal stake in the case, a financial interest, or personal hostility toward a party. However, simply claiming that the other side boasted about getting favour from the court, with no concrete evidence of improper conduct by the judge, is not enough to prove bias. The court stressed that transfer of cases cannot be granted on mere suspicion or convenience of a party; there must be solid, trustworthy evidence of actual bias or interest.

This ruling matters because it reinforces that courts will not easily permit parties to shop for different judges based on unsubstantiated fears, protecting the integrity and stability of ongoing trials.
