CLC 2024 509 · Balochistan High Court

This case involved a property dispute over land in Quetta district. The plaintiffs (respondents in this appeal) claimed that their predecessor had purchased the disputed land through an agreement in 1995, but the agreement was never acted upon and the property remained registered in the name of the sellers' side. The plaintiffs sued for declaration of ownership, cancellation of records, partition, enforcement of the sale agreement, and related relief.

While the suit was ongoing, the defendants asked the trial court to reject the plaint outright, arguing the agreement had nothing to do with the actual land in question and that disputes over revenue entries could only be handled by revenue authorities, not civil courts. The trial court agreed and dismissed the case without a full hearing. On appeal, the appellate court reversed this and sent the case back for a proper trial. The defendants then challenged that reversal before the High Court.

The High Court upheld the appellate court's decision. It held that when a case involves genuinely disputed facts, such as whether an agreement is genuine or relates to the property in question, the court cannot simply throw out the case at a preliminary stage. Instead, it must let the parties present evidence and decide the issues on merit. The court also rejected the argument that civil courts lacked jurisdiction, noting that civil courts can hear such disputes unless a law specifically bars them. The revision petitions were dismissed, meaning the case will now proceed to trial.
