Muhammad Saleem V. The Assistant Commissioner Turbat and another,
CLC 2024 1797 · Balochistan High Court
This case was about a land dispute in Turbat involving a cell phone tower. Ufone, a mobile company, had leased land from Muhammad Saleem to install a communication tower, and a local land official (Patwari) had confirmed the land belonged to him. However, another party claimed ownership of the same land and filed a complaint with the Assistant Commissioner Turbat, who ruled in their favor, declaring that the land belonged to them instead.
Saleem challenged this decision before the Balochistan High Court, arguing that the Assistant Commissioner had no authority to decide such a dispute.
The High Court agreed with him. It held that when a genuine dispute over property ownership exists, especially involving allegations of fraud, only a civil court can resolve it, because civil courts have full ("plenary") power to examine evidence and hear both sides properly. Revenue authorities, like the Assistant Commissioner, only handle matters in a summary, limited way and cannot settle complicated ownership disputes. The court explained that a "question of title" arises whenever someone denies another person's ownership claim, and such questions must go to a civil court, not be decided administratively.
Since both parties claimed ownership and denied each other's rights, the Assistant Commissioner's order was declared unlawful and set aside. The case highlights that ownership disputes must be resolved through proper civil litigation, not through quick administrative decisions.
