Sawab Din and others V. Civil Judge Dera Bugti at Sui and others,

CLC 2023 557 · Balochistan High Court

This case involved a property dispute where the petitioners (plaintiffs) had filed a suit seeking a declaration, cancellation of a mutation entry, and a permanent injunction, claiming they owned and possessed certain property that had been fraudulently transferred to someone else's name.

The trial court dismissed their suit for non-appearance on a hearing date. However, that date had actually been fixed only for the opposing party (defendants) to file their written statement, not for substantive hearing of the case. The petitioners' request to restore the suit was rejected, and their appeal to the Additional District Judge was also dismissed.

The Balochistan High Court examined whether a date set merely for filing a written statement counts as a date of hearing under Order IX, Rule 8 of the Civil Procedure Code, the provision allowing dismissal of a suit when a plaintiff fails to appear.
