Almas Mandokhail V. Ainuddin and others,
CLC 2023 374 · Balochistan High Court
This case involved a dispute over ownership of a house in Quetta after the original owner died and the property passed to his children as legal heirs. One of the heirs, Mouzam Iqbal, allegedly sold his share through an unregistered sale agreement to another man, Tariq Mehmood, who allegedly sold it again through another unregistered agreement to the petitioner's father. Later, the father reportedly gave the house to the petitioner through an affidavit. Separately, the other legal heirs sold the house through proper mutation to a different buyer, Ainuddin. The petitioner sued for declaration of ownership, cancellation of that mutation, and an injunction, relying on the chain of unregistered sale agreements.
The trial court ruled in the petitioner's favor, but the appellate court reversed this and dismissed the suit. The High Court upheld the appellate court's decision and dismissed the petitioner's revision.
The court explained that under the Registration Act and the Transfer of Property Act, any document transferring ownership of immovable property worth more than a certain value must be registered. An unregistered sale agreement does not transfer ownership or create title in the property; it only gives a right to seek enforcement of the agreement through a court (specific performance). Since the petitioner's claim rested entirely on unregistered agreements, it could not establish legal ownership, making the suit for declaration unsustainable.
This case reinforces an important principle in property law: informal or unregistered sale agreements, even with possession or partial payment, do not make someone the legal owner of property. Only
