Alamzaib Khan V. Kasi Behria Town Main Jinnah Road, Quetta through CEO,
CLC 2023 2050 · Balochistan High Court
This case involved a property dispute in Quetta. A buyer, Alamzaib Khan, had agreed to purchase two plots from a housing scheme called Kasi Behria Town under an installment plan, paying an advance of Rs. 40,000 plus monthly installments of Rs. 10,000. By the time of the dispute, he had already paid more than half the total price of Rs. 800,000. He filed a lawsuit seeking specific performance of the sale agreement (that is, forcing the seller to complete the sale) along with a declaration and permanent injunction, and asked the court for a temporary injunction to stop the housing scheme from cancelling his allotment or transferring the plots to someone else while the case was pending.
Both the trial court and the appellate court refused to grant this temporary injunction. Khan then challenged those refusals before the Balochistan High Court.
The High Court explained that to get a temporary injunction, a person must show a prima facie case, risk of irreparable loss, and that the balance of convenience favors them. Reviewing the facts, the judge found that since Khan had already paid over half the purchase price under a valid agreement, he clearly had a strong prima facie case, and he risked serious loss if the property were sold to someone else. The High Court ruled that the lower courts were wrong to deny the injunction, set aside their orders, and granted the temporary injunction in Khan's favor, protecting his claim to the plots until the main case is decided.
