Muhammad Naseem Javed V. Anjuman-E-Asna Ashria and another,

CLC 2022 830 · Balochistan High Court

This case was about a dispute over an Imam Bargah (religious congregation hall) property in Quetta. The petitioner, Muhammad Naseem Javed, sued seeking a declaration that the original name of the institution was "Anjuman-e-Asna Ashria Hazara," challenging an official letter that had removed the word "Hazara" from its registration, and asking for cancellation of related documents plus a permanent injunction preventing removal of the word "Hazara" from the building's signage.

The trial court initially ruled in his favor, but on appeal the Additional District Judge reversed that decision and dismissed the suit entirely. The matter then came before the Balochistan High Court in revision.

The High Court upheld the dismissal. It found that the petitioner himself had admitted the property in question was waqf property (a charitable or religious endowment). Under Section 92 of the Civil Procedure Code, lawsuits involving public charitable or religious trusts require prior permission from the Advocate General before they can be filed in court. Since Javed had not obtained this permission, and his claims fell within the type of relief covered by Section 92, his suit was not legally maintainable from the outset.

The court explained that this rule exists to protect public religious and charitable trusts from being misused for private disputes, ensuring such institutions are not harassed by individuals pursuing personal interests under the guise of protecting public trust property. The revision petition was therefore dismissed, and the appellate court's decision stood.
