This case is about a challenge to how the Balochistan government awarded contracts for building water dams. The Irrigation Department had invited pre-qualified contractors to bid on 23 dam projects across different districts under Package-IV of a 100 Dams program. After receiving applications, the Project Director proposed merging or packaging ten of these dams (located in four districts) into just four combined contracts, arguing this would attract stronger, better-resourced firms and improve construction quality, based on lessons learned from earlier packages where progress had lagged. This plan was approved by the Secretary of the Irrigation Department.
Two contractors who had pre-qualified for some of these individual dam projects challenged this packaging decision in the Balochistan High Court, arguing it unfairly changed the terms after they had already applied and disadvantaged them.
The High Court agreed with the petitioners. It held that government contracts involving public money and public interest must be fair, transparent, and free from arbitrary or biased decision-making, and that such actions are subject to judicial review under Article 199 of the Constitution. The court declared the merging of the ten dams into four contracts, along with the related pre-qualification summary, null and void. Since financial bids had not yet been opened, the court cancelled them and directed authorities to invite fresh bids for all ten dams as separate, individual projects, restoring the original competitive process for the previously pre-qualified companies.
