CLC 2022 722 · Balochistan High Court

This case was about a property dispute in Balochistan. A group of people filed a civil suit asking a court to cancel certain revenue entries (land records) and to declare their rights over disputed land, along with seeking a permanent injunction. The people being sued had initially tried to get the case thrown out early using a procedural rule (Order VII, Rule 11 of the Civil Procedure Code), arguing the suit was filed too late and had no valid legal basis. The trial court (Qazi Bhag) rejected that request, saying the issue of limitation needed to be decided only after evidence was presented. However, on appeal, the Majlis-e-Shoora overturned that decision and dismissed the plaintiffs' case outright, ruling it was filed way too late.

The plaintiffs then challenged that dismissal before the Balochistan High Court, arguing that whether their suit was time-barred was a mixed question of fact and law that needed a full trial with evidence, not an early dismissal.

The High Court disagreed with the plaintiffs. It explained that when deciding such early dismissal applications, courts only look at what is written in the plaint itself, assuming it to be true. Here, the plaintiffs' own pleadings showed that their predecessor had known about the disputed land entries for 48 years but never challenged them. Because of this long, unexplained delay, the court held the suit was clearly barred by limitation just from reading the plaint, so no trial was needed. The petition was dismissed, reaffirming that courts can and should screen out clearly time-barred or baseless suits
