Shakarullah v. Bibi Shakeela and another,
CLC 2022 574 · Balochistan High Court
This case involved a family dispute from Kharan, Balochistan. Bibi Shakeela had filed a suit against her husband, Shakarullah, seeking recovery of her dower amount, gold ornaments, maintenance for the Iddat period, and dowry articles. The Family Court dismissed her suit, holding that she had failed to meet the strict evidentiary requirements of the Qanun-e-Shahadat (Pakistan's law of evidence) when presenting her documentary and oral evidence.
Shakeela appealed, and the Additional District Judge, Kharan, partly accepted her appeal and sent the case back to the Family Court for fresh proceedings. Her husband then challenged this remand order before the Balochistan High Court.
The High Court upheld the appellate court's decision and dismissed the husband's petition. It explained that Family Courts exist specifically to provide quick, simple justice in family matters without getting bogged down in technical procedural rules. Under Section 17 of the Family Courts Act, 1964, the strict application of the Civil Procedure Code and the Qanun-e-Shahadat is excluded from family court proceedings.
