Agha Construction Company through Proprietor V. Government of Balochistan through Secretary, Mineral and Mines Deptt. and another ,
CLC 2022 550 · Balochistan High Court
Agha Construction Company challenged how Balochistan's Mines and Minerals Department handled a contract for collecting royalty on minerals across several districts. The department had auctioned the contract, but the first highest bidder failed to meet the contract terms, so his security deposit was forfeited. The contract was then offered to the petitioner, the second highest bidder, who was supposed to sign the agreement within ten days. When he too failed to do so, his security deposit was also forfeited, and his later appeal to the Secretary of the department was dismissed.
The petitioner argued he never actually received the offer letter and was never given a chance to explain before his deposit was forfeited. The High Court examined the relevant mining rules and the official offer letter, and found that the letter did not show the required government approval and that the department produced no evidence proving the petitioner had been given an opportunity to respond before the forfeiture decision.
The Court also noted that the department had improperly extended royalty collection arrangements between auctions for about a year without proper authority, which could harm government revenue if left unchecked.
As a result, the Court partly allowed the petition, set aside the Secretary's order, and sent the appeal back to be decided afresh—emphasizing that administrative forfeiture decisions affecting money and rights require fair process and proper authorization.
