Asad Javed V. Ahmed Shah,

CLC 2022 537 · Balochistan High Court

This case involved a dispute over an unpaid loan between relatives in Quetta. The plaintiff (respondent before the High Court) claimed he lent over Rs. 20.8 lakh to the defendant (appellant) for starting a business, and in return received a crossed cheque as repayment. When he deposited the cheque, it bounced due to insufficient funds. He sued for recovery under a special summary procedure (Order XXXVII, Civil Procedure Code) meant for quick recovery on negotiable instruments like cheques.

The defendant denied owing any money, claiming the cheque had actually been stolen from him by the plaintiff's brother, who he said he had lent only a small sum to. The trial court disbelieved this defense and decreed the suit in the plaintiff's favour, ordering recovery of the full amount.

On appeal, the Balochistan High Court upheld this decision. It reasoned that under Section 118 of the Negotiable Instruments Act, a cheque is legally presumed to have been issued for consideration (i.e., for a real debt), and the burden falls on the person denying this to prove otherwise. Since he failed to rebut the legal presumption attached to cheques, his appeal was dismissed.

The judgment reinforces that mere denial of liability is not enough to escape payment once a cheque is shown to be genuinely issued; concrete ev
