CLC 2022 372 · Balochistan High Court

This case concerns a marriage dispute. The wife had sued for dissolution of her marriage along with recovery of dower, dowry articles, and maintenance, alleging cruelty, misconduct, and non-maintenance by her husband. The Family Court ruled in her favor, dissolving the marriage on grounds of cruelty and ordering payment of dower, maintenance, medical expenses, and return of gold ornaments and other items. The husband appealed, but the appellate court returned his appeal, saying it had no jurisdiction to hear it.

The husband then approached the Balochistan High Court. The key legal question was whether an appeal against a marriage dissolved on the ground of cruelty was allowed, given that the Family Courts Act generally bars appeals against dissolution decrees except in one specific situation involving a husband's inability to maintain his wife due to impotence. The High Court held that appeals against dissolution of marriage are barred except in that narrow circumstance, so the husband could not challenge the dissolution itself. However, the court found that the appellate court had wrongly refused to hear the parts of the appeal relating to dower, maintenance, gold ornaments, and medical expenses, since those issues were not covered by the same bar. The court also clarified that cruelty under the law includes mental and behavioral mistreatment, not just physical violence. The petition was partly allowed, restoring the appeal on the financial matters.
