CLC 2022 1987 · Balochistan High Court
This case concerns a landlord-tenant dispute under the Balochistan Urban Rent Restriction Ordinance, 1959. A landlord filed an eviction application against his tenant, Sher Muhammad, citing rent default and his own personal need for the property. The tenant resisted eviction by denying that any landlord-tenant relationship existed at all, claiming instead that he occupied the house as the tenant of a different person who, he argued, was the real owner.
The Rent Controller in Quetta ordered the tenant to vacate, and the tenant appealed to the Balochistan High Court. The High Court upheld the eviction. It found that the tenant's claimed alternate landlord had actually sued in civil court to establish his ownership claim, and that case had been dismissed and never appealed, so it was legally settled against him. Meanwhile, the actual landlord produced official mutation records proving ownership, while the tenant produced no documents proving his own claimed right to possession.
The court also rejected the argument that rent receipts or written agreements were necessary to prove tenancy, holding that a verbal agreement is sufficient under the law. Importantly, the court ruled that when a tenant denies the landlord's title without proof, and is found to actually be a tenant, he effectively becomes a trespasser and forfeits his tenancy, making eviction automatic. This case clarifies that tenants cannot escape eviction merely by disputing ownership unless they can back up that denial with solid evidence.
