CLC 2022 1764 · Balochistan High Court
This case involved a dispute over agricultural land in Quetta between neighboring families. The petitioners claimed they inherited the land from their forefathers and that neighboring landowners (the respondents) had wrongly trespassed onto their property after jointly building a boundary wall between the two plots. The respondents argued they had privately divided the inherited property decades earlier, had been in continuous possession of the disputed land for about 40 years, had dug a tube-well, grown crops, built walls, and constructed a house on it.
Both the trial court and the first appellate court ruled against the petitioners, finding that the respondents had proven long, uninterrupted possession while the petitioners failed to prove theirs.
The Balochistan High Court reversed these decisions. It held that the petitioners had produced official mutation (land record) entries and witness testimony establishing their ownership, and the respondents never proved these records were fake or fraudulent. Under the law, such revenue records carry a presumption of truth unless disproved. The court also noted that mere possession, even if long-standing, cannot defeat the rights of the true, documented owner, and that oral evidence cannot outweigh official documents. Citing Islamic legal principles, it added that long possession alone (akin to adverse possession) cannot create ownership.
The court allowed the revision petition, set aside the lower courts' rulings, and restored the petitioners' ownership and possession rights, reinforcing that documentary land records take precedence over claims based solely on physical possession.
