CLC 2022 1382 · Balochistan High Court
This case is about a property dispute in Balochistan involving the Islamic law right of pre-emption, which allows certain people, such as neighboring landowners or co-sharers, to claim first right to purchase land when it is sold to someone else.
The appellant, Bevergh Khan, claimed that land adjacent to his property had been sold by the respondents without informing him, and that he was entitled to claim it under the right of pre-emption since his land shared a water source with it. His pre-emption suit was dismissed by the trial court, and he appealed to the Balochistan High Court.
The High Court upheld the dismissal for several reasons. First, the appellant failed to properly describe his property or clearly prove that his land was actually adjacent to the disputed land, a claim the respondents disputed. Second, under Islamic law as codified in the Muhammadan Law applicable in Balochistan, a person claiming pre-emption must immediately assert this right upon learning of the sale, a formal step called Talab-i-Muwathibath, and then promptly repeat the demand before witnesses, referencing the first demand, known as Talab-i-Ishhad. The appellant's plaint and evidence did not specify the date, time, or place when he made this immediate first demand, which is a strict legal requirement.
Because these essential technical and procedural requirements were not met, the court ruled that the appellant had not established his right to pre-emption, and the appeal was dismissed.
