CLC 2022 1282 · Balochistan High Court
This case is about a dispute over land in Kuchlak, Balochistan. A man who ran a school filed a civil suit asking the court to declare his ownership of certain land and to stop his neighbours from building shops on adjoining land that he claimed encroached on his property. The defendants contested the suit and filed their written response. While the case was ongoing, the plaintiff tried to withdraw his suit, seeking permission to file a fresh one later. The trial court allowed this withdrawal, but the defendants appealed, and the appellate court reversed that decision, refusing to let the plaintiff withdraw with the right to refile. The plaintiff then challenged this in the Balochistan High Court.
The High Court upheld the appellate court's decision and dismissed the plaintiff's petition. It held that under the law governing withdrawal of suits (Order XXIII of the Civil Procedure Code), a plaintiff cannot withdraw a case and get permission to refile it just because he wants to—he must show either a formal legal defect in the original suit or some other genuine, sufficient reason, and the court must be satisfied this isn't being done to harm the other side or misuse the legal process. Here, the plaintiff gave no real justification, a court-appointed inspection had already taken place, and allowing withdrawal would unfairly disadvantage the defendants. The ruling clarifies that withdrawal with permission to refile is not an automatic right but requires proper judicial scrutiny.
