Abdul Raziq V. Muhammad Rafiq and others,

CLC 2022 1048 · Balochistan High Court

This case is about a property pre-emption dispute from Quetta, Balochistan. Under pre-emption law, a person claiming the right to buy adjoining property must make a timely declaration called talb-i-muwathibat, and the exact date, time, and place of this declaration are legally crucial.

The plaintiff, Abdul Raziq, had stated in his plaint that he learned about the sale and made his declaration at 12:26 AM at the tehsil office. The buyers pointed out in their written statement that this timing was implausible, since a patwari would not be present at a government office at that hour. After this objection was raised, the plaintiff applied to correct AM to PM, claiming it was an accidental typing error. The trial court allowed the correction, but on revision, the Additional District Judge reversed this, and later also rejected the plaintiff's attempt to reopen that decision.

The High Court upheld the rejection of the correction. It ruled that even an interim order can be treated as a final "case decided" under the law if it affects the merits of the case, so revision was properly available. It also held that because the correction was sought only after the defendants specifically challenged the timing, and because it would change the fundamental character of the suit and erase the defense already raised, it was not a genuine clerical fix but an attempt to manipulate the case. The petition was dismissed, reaffirming that precise time details in pre-emption claims cannot be casually altered once challenged.
