CLC 2021 911 · Balochistan High Court
This case involved a dispute over dowry articles worth over 1.3 million rupees. A wife filed a suit against her husband for recovery of these items. Rather than contesting the suit on its merits, the husband offered a settlement: he proposed that if the wife took a special oath on the Holy Quran swearing that the articles had not been returned to her, he would pay the full amount claimed. The wife accepted this offer and took the oath in court. Based on this, the Family Court decided the case in her favor, and an appeal by the husband was also rejected.
The husband then challenged the decision in the High Court, arguing that the oath procedure violated Article 163 of the Qanun-e-Shahadat Order (Pakistan's law of evidence), since technically it should have been the plaintiff making the offer of oath, not the defendant, and that this law didn't even apply to Family Court cases.
The High Court dismissed his petition. It held that the Qanun-e-Shahadat law does not apply to Family Court proceedings, which can set their own procedures. However, nothing stops a Family Court from resolving a dispute through a special oath if the parties agree to it. Since the husband himself had proposed the oath and the wife had acted on it, he could not later back out of the agreement. The court applied the principle that one cannot accept the benefits of an arrangement and later reject it. This case clarifies that voluntary oath-based settlements in Family Court are valid and binding, even without strict adherence to evidence law.
