Syed Habibullah V. Syed Abdul Khabeer,
CLC 2021 708 · Balochistan High Court
This case involved a landlord-tenant dispute under Balochistan's rent laws. The landlord, Syed Abdul Khabeer, sought to evict his tenant, Syed Habibullah, from a shop, claiming the tenant was a bad payer and that the landlord and his brothers genuinely needed the shop to start their own business. The Rent Controller sided with the landlord and ordered the tenant to vacate within thirty days. The tenant appealed to the Balochistan High Court.
The High Court overturned the eviction order. It found the landlord had failed to prove his claimed need was genuine. Notably, the landlord was simultaneously trying to evict 22 tenants from separate shops on the same personal-need claim, yet he had not obtained municipal permission for any reconstruction or alteration of the building. His brothers, for whom the shops were supposedly needed, were not even named in the eviction application, lived abroad, ran independent businesses, and rarely visited Pakistan. Additionally, the property was actually registered in the landlord's father's name, yet the father was not the one who filed the eviction case.
The court held that while landlords generally have a stronger right to use their own property, tenants cannot be thrown out merely on a landlord's unproven assertions, whims, or desire to raise rents. Genuine "need" must be distinguished from mere "greed." Finding no real proof of bona fide necessity, the High Court accepted the tenant's appeal and dismissed the eviction application.
