CLC 2021 592 · Balochistan High Court
This case involved a family dispute over inherited property in Pishin, Balochistan. The plaintiffs (who became petitioners before the High Court) sued their relatives claiming shares in ancestral property left by their late father, seeking declarations of ownership, partition, cancellation of a mutation entry, and other relief. While the suit was pending, the plaintiffs asked the trial court to appoint a receiver to take control of the property and also asked to add a Telenor company official as a party to the case. The trial court rejected both requests, and the District Judge upheld that decision on revision. The plaintiffs then challenged these rulings before the Balochistan High Court.
The High Court dismissed the petition, agreeing with the lower courts. It explained that appointing a receiver is a serious, drastic remedy that courts should use cautiously, only when it is truly just and convenient to protect property during litigation. A party seeking a receiver must show a strong prima facie case, prove their claim to the property, and demonstrate real risk of loss or misuse of the property - mere apprehension of mismanagement is not enough. Here, the property was already in the defendants' possession, officially recorded in their names, and the plaintiffs had not yet proven their ownership claims at trial, nor shown any urgent emergency. Finding no legal error in the lower courts' decisions, the High Court dismissed the petition outright, reinforcing that receivership is an exceptional remedy, not a routine one.
