CLC 2021 532 · Balochistan High Court
This case involved a challenge to parts of the Balochistan government's 2019 recruitment policy for teaching staff (BPS-09 to 15). The petitioners, who were candidates seeking appointment, objected to specific clauses of the 2019 policy and wanted the government to instead follow an earlier, more favorable rule from the 2014 recruitment policy. They argued the older policy's method of filling vacancies would give them a better chance of appointment if selected candidates failed to join their posts.
The government's side argued that the 2019 policy was updated deliberately, based on a Supreme Court ruling that the earlier 2014 policy hadn't accounted for, and that recruitment rules already protect district and zonal-based allocation of posts, so there was nothing improper about the change.
The Balochistan High Court examined the disputed clauses closely and compared them with the earlier policy and the relevant civil service rules. It found that the 2019 policy's method of ranking candidates by village, union council, tehsil, and district was actually consistent with the earlier policy and with the established recruitment rules. The court held that government policies cannot be struck down by courts unless they are shown to be made in bad faith, arbitrarily, or as an abuse of power. Since there was no evidence of that here, and the petitioners suffered no real prejudice, the court dismissed the petition. This case is significant because it reinforces how much deference courts give to government policy-making decisions, intervening only when there's clear misuse of power.
