CLC 2021 187 · Balochistan High Court

This case involved a long-running family property dispute between brothers over inheritance left by their late father. The appellant had earlier filed a suit for partition of family properties, which was dismissed after the defendants' attorney took a special religious oath explaining how the property had already been divided among the brothers. That dismissal was upheld on appeal. The appellant also tried, separately, to have an arbitrator's award on the same property partition made enforceable through the courts, but that attempt was dismissed too.

Years later, the appellant filed a fresh suit, this time asking for declaration, possession through partition, and cancellation of certain mutation entries, concerning essentially the same inherited properties. The trial court threw out this new suit, ruling that it was barred by the legal principles of res judicata (a matter already decided cannot be relitigated) and under Order II, Rule 2 of the Civil Procedure Code, which prevents a person from splitting a single cause of action into multiple lawsuits.

The High Court agreed. It held that since the earlier partition suit and the arbitration matter had already been conclusively decided, the appellant could not bring the same dispute back to court under a different label. The court emphasized the core principle that no one should be sued or vexed twice over the same cause of action, and litigation must eventually end. The appeal was dismissed.

This case reinforces important procedural rules preventing repeated litigation over settled disputes, promoting finality in legal proceedings.
