Shaban Khuda Bakhsh V. Hatima Ameer and 2 others,

CLC 2021 1807 · Balochistan High Court

This case is about a family dispute over money left in a deceased man's bank account. After Khuda Bakhsh died, his son applied for a succession certificate under the Succession Act, 1925, so that the money in his father's National Bank account could be legally distributed among the heirs. The deceased's widow objected, claiming that a large part of the amount did not belong to the estate at all, arguing it was actually proceeds from the sale of two plots that she co-owned with her husband, and that only a smaller amount should be divided among the legal heirs.

The trial court examined the claims and issued a succession certificate dividing the full amount among the son, widow, and daughter according to their Islamic inheritance shares. The widow challenged this decision before the Balochistan High Court.

The High Court upheld the trial court's decision and dismissed the appeal. It explained that succession certificate proceedings are meant to be quick and summary, not detailed trials. Complicated questions about who actually owns disputed property, such as the widow's claim over the sale proceeds, cannot be properly resolved in this limited process. Such ownership disputes must instead be decided through a full civil lawsuit where evidence can be thoroughly examined.

This case is important because it clarifies the limited scope of succession certificate proceedings and confirms that real estate or property ownership disputes among heirs require a separate, full court suit rather than being settled in summary inheritance proceedings.
