CLC 2021 1788 · Balochistan High Court

This case involved a family dispute over property left by a deceased man, Ghulam Sabir, between his children. Some of the legal heirs (the petitioners) claimed they were the rightful owners of certain properties based on a Will their father had made during his lifetime, which they said gave them exclusive rights. Other legal heirs (the respondents) disputed this, saying they had never agreed to such a Will and that it did not comply with Islamic law. They wanted the property divided among all heirs according to Sharia inheritance shares.

Both the trial court and the first appellate court ruled against the petitioners, finding that the Will could not override the rights of heirs who never consented to it. The Balochistan High Court, hearing the case in its revisional jurisdiction, upheld these decisions.

The High Court explained a key principle of Islamic law: a person can only bequeath up to one-third of their property through a Will, and any bequest to a legal heir beyond that is invalid unless all other legal heirs voluntarily consent to it. Since the other heirs here did not consent and actively contested the Will, it could not be enforced in the petitioners' favor. Instead, the property had to be distributed through normal inheritance rules among all heirs.

This case reinforces an important protection in Islamic inheritance law: a parent cannot sideline some legal heirs in favor of others through a Will unless everyone agrees, ensuring fairer distribution of inherited property.
