Bibi Quresh V. The Government of Balochistan, through Secretary Home and Tribal Affairs Department and 3 others,
CLC 2021 1635 · Balochistan High Court
This case involved a property dispute in Quetta. Bibi Quresh filed a constitutional petition before the Balochistan High Court, asking it to stop government authorities from dispossessing her from a piece of property she claimed was disputed. She also wanted the court to declare that officials had acted illegally by treating the property as undisputed and potentially favoring another private party in the matter.
However, the court discovered that Bibi Quresh had already filed a separate civil suit for declaration and permanent injunction over the same property before a Civil Judge in Quetta, and that case was still pending. Additionally, her lawyer repeatedly failed to appear in court on multiple hearing dates, suggesting a lack of interest in pursuing the constitutional petition.
The High Court ruled that since she already had an adequate alternate legal remedy through her pending civil suit, it was not appropriate for her to also seek relief through the High Court's special constitutional jurisdiction. Citing Supreme Court precedents, the judges reaffirmed the principle that constitutional petitions should not be entertained when a party is already pursuing the same issue through ordinary civil litigation. As a result, the petition was dismissed outright.
This case matters because it reinforces an important legal principle: courts expect people to use the normal legal channels available to them (like civil suits) rather than jumping straight to higher constitutional remedies, except in cases where no other adequate remedy exists.
