This case involved a dispute between a landlord and an alleged tenant over a grocery shop in Hub, Balochistan. The landlord, Achar, filed an application to evict Wahid Bakhsh, claiming he was his tenant who had defaulted on rent and was needed for personal use. Wahid Bakhsh denied that any landlord-tenant relationship existed between them at all. The Rent Controller sided with the landlord and ordered eviction, relying on documents such as mutation entries, a map prepared by a government official, a Tehsildar's report, and a land revenue decision, which supposedly proved the landlord's ownership and the tenancy relationship.
The Balochistan High Court overturned this decision. It found that these crucial documents were never properly proved in court, as required by law. Nobody who had signed or issued the documents was called as a witness, and no other evidence confirmed their authenticity. The court explained that simply having documents on file isn't enough; they must be formally proved, especially when their authorship or origin is disputed, so the other side can test them through cross-examination.
Since the eviction order rested entirely on unproven documents, the High Court ruled it was legally unsound. It set aside the ejectment order and sent the case back to the Rent Controller to be decided again, this time following proper legal procedure for presenting and proving evidence. The appeal was allowed, reinforcing that courts cannot rely on documents that have not been properly authenticated in legal proceedings.
