CLC 2021 1342 · Balochistan High Court

This case involved a husband who challenged a family court's decision granting his wife a divorce through khula (a wife-initiated dissolution of marriage) along with striking off his right to defend the case.

The wife had filed a suit seeking dissolution of her marriage on grounds of cruelty, stating she was willing to give up her dower rights, along with a claim for return of a laptop. The husband contested the suit and filed a written statement, but despite being given several opportunities by the Family Court to appear for mandatory pre-trial reconciliation proceedings, he repeatedly failed to show up. As a result, the trial court struck off his right to defend the case and proceeded to hear only the wife's evidence, eventually granting the divorce.

The husband challenged this before the High Court, arguing that the family court had no specific legal power to strike off a defendant's right to defend simply for not attending reconciliation hearings.

The High Court disagreed and dismissed his petition. It held that although the Family Courts Act does not explicitly mention striking off a defense, the phrase "if any" used in the law implies that courts are not meant to be helpless bystanders when a defendant fails to cooperate.
