Muhammad Usman and another V. Bibi Amina and others,
CLC 2021 1196 · Balochistan High Court
This case is about a land dispute in Lasbella district, Balochistan. A plot of land was originally owned by two people (respondents Nos. 2 and 3). Someone claiming to act under a power of attorney sold the land through an unregistered sale agreement to Muhammad Usman, and mutation entries (official land record changes) were made in his favour, and later transferred again to two other petitioners. The original owners challenged these mutations before revenue authorities, who cancelled them and restored ownership to the original owners. This decision was upheld through multiple levels of appeal, eventually reaching the Board of Revenue, and then the Balochistan High Court.
The petitioners argued that only a civil court, not revenue officials, could resolve such disputed questions of fact and fraud, and that they were denied a chance to present evidence.
The High Court disagreed. It held that under the Balochistan Land Revenue Act, 1967, mutations based on unregistered documents (rather than inheritance, registered deeds, or court orders) are not valid unless proper identification and inquiry procedures are followed, which had not happened here. Since the error was obvious from the record itself, correcting it fell within the revenue authorities' own powers, not the civil court's. The court dismissed the petition, meaning the land stayed with the original owners, while noting that if the petitioners wanted to claim title, they would need to approach a civil court instead.
This case matters because it clarifies when revenue authorities, rather than civil courts, can correct land records, especially regarding unregistered property transfers.
