Dr. Aziz Ur Rehman and others V. Noor Bibi and others,
CLC 2021 106 · Balochistan High Court
This case involved a family property dispute in Balochistan. A daughter (the plaintiff) sued her brothers and others, claiming she had been unlawfully deprived of her rightful inheritance share in her deceased father's property. She argued that certain mutations (land record transfers) and a gift claimed by the defendants were illegal, and that the property had later been sold or exchanged to other people without her consent.
The trial court and the appellate court both ruled in her favor, finding that the alleged gift was never properly proven and that mere transfer of possession does not make a gift valid. Several petitioners then challenged these decisions before the Balochistan High Court through revision petitions.
The High Court dismissed the revisions, upholding the lower courts' findings. It held that a legal heir's right to inherit does not expire with time, since limitation does not apply to void transactions. It also ruled that co-sharers cannot transfer more property than their own share, and that anyone who bought land from such co-sharers could only claim rights from the sellers' shares, not from the rightful heir's portion. The court emphasized that concurrent findings of fact by two lower courts cannot be disturbed unless clearly unjust or unlawful.
This judgment reinforces protections for women's inheritance rights under Islamic law and clarifies limits on property transfers by co-owners and the responsibilities of purchasers to verify ownership before buying land.
