Syed Muhammad Ali V. Syed Fasahat Hussain and 5 others,

CLC 2020 976 · Balochistan High Court

This case is about a property dispute over a house in Quetta. The petitioner (Syed Muhammad Ali) claimed he bought the house in 1985 from respondent No.1 through sale agreements and an irrevocable power of attorney, and that possession was handed over to him. He said he later rented the house out, but the tenant (respondent No.2) fraudulently obtained a second power of attorney from the original owner and transferred the property to himself, who then transferred it to respondent No.3. The petitioner claimed he only discovered this in 1997 and filed a suit for specific performance seeking enforcement of his purchase.

The respondents argued that the petitioner himself had sold the house to respondent No.2 shortly after buying it, and asked the original owner to issue the second power of attorney to allow transfer and loan adjustment with the House Building Finance Corporation. Both the trial court and the appellate court dismissed the petitioner's suit, finding it was filed too late (barred by limitation) and that he failed to prove he still possessed the property or to disprove the documents against him.

The High Court upheld these decisions. It ruled that limitation is not a mere technicality - courts must dismiss time-barred suits even if the issue isn't specifically raised as a defense. Since no real legal error was found in the lower courts' reasoning, the revision petition was dismissed, meaning the petitioner lost his claim to the house.
