CLC 2020 963 · Balochistan High Court

This case involved a land dispute in Sibi, Balochistan, over shared agricultural land described as shamilat (common village land). The plaintiffs, who owned shares in the land, claimed that one co-owner, the respondent, had occupied far more land than his actual share and asked the civil court for a declaration of ownership, partition of the property, and an injunction against the respondent.

The trial court, after hearing evidence, decided it did not have jurisdiction to hear the case and returned the plaint, directing the plaintiffs to instead approach the Revenue Court, since partition of land was already pending before the Assistant Commissioner. The appellate court upheld this decision, prompting the plaintiffs to file this revision petition before the Balochistan High Court.

The High Court dismissed the petition. It held that under the Balochistan Land Revenue Act, 1967, matters of partitioning shared land fall exclusively within the jurisdiction of Revenue Officers, not civil courts. The law specifically bars civil courts from hearing partition-related disputes once the matter is before revenue authorities. The court also clarified that revenue officers themselves have full power to resolve questions of ownership or title when deciding partition cases, so there was no need for a separate civil suit.

This ruling reinforces that disputes over partitioning jointly-owned land in Balochistan must go through revenue authorities rather than civil courts, especially when such proceedings are already underway, ensuring the specialized revenue law mechanism is respected over general civil litigation.
