Bibi Kalsoom V. The General Public and others,

CLC 2020 943 · Balochistan High Court

This case involved a family pension dispute after the death of a government schoolteacher in Balochistan. His children, including his unmarried daughter Bibi Kalsoom, applied to the courts for a succession certificate to claim his pension dues and other benefits. While the lower courts granted the siblings their share of the dues, they denied Bibi Kalsoom's specific claim to receive her father's monthly pension, reasoning that since she was above 21 years of age, she was not entitled to it as an unmarried daughter.

Bibi Kalsoom challenged this decision, first in an appeal before the District Judge, Pishin, which was also rejected, and then through this civil revision petition before the Balochistan High Court.

The High Court examined a 1998 government notification that amended the Balochistan Civil Services Pension Rules, 1989. This notification stated that an eldest unmarried daughter of a deceased government servant is entitled to family pension until she marries, without mentioning any age limit or cutoff at 21 years. The court found that the lower courts had misunderstood the law and wrongly imposed an age restriction that did not exist in the actual rules, causing injustice to the petitioner.

The High Court set aside both lower court orders and directed the relevant government department to process her pension claim properly. This judgment clarifies that unmarried daughters remain eligible for their deceased father's family pension regardless of age, as long as they remain unmarried, protecting their financial rights under pension rules.
