CLC 2020 526 · Balochistan High Court

This case involved a dispute between tenants and a landlord organization over shops located near Imam Bargah Nasir-ul-Aza in Quetta. The landlord had filed an eviction petition seeking to reclaim three shops, stating it wanted to demolish walls and incorporate the shops into the Imam Bargah complex for use as a library, storage, and staff residences. The tenants resisted, arguing that an earlier eviction petition filed by the same landlord had already been dismissed, and that this should bar a fresh attempt.

The Balochistan High Court rejected this argument, clarifying that under the Rent Ordinance, a new eviction petition is only barred if the earlier one was decided on its merits. Since the first petition had been dismissed merely for non-prosecution (meaning it was never actually examined or decided), the landlord was free to file again on the same grounds.

The court also addressed other issues raised by the tenants, including payment of pagri (a premium paid by tenants), ruling that such payment does not create permanent tenancy rights or prevent eviction. It found that the landlord had demonstrated a genuine, bona fide need for the premises, and that the eviction application filed through an authorized attorney was valid.

Ultimately, the court upheld the lower court's decision ordering the tenants to vacate within two months, emphasizing that an owner's property rights take precedence over a tenant's occupancy rights. This case clarifies when dismissed cases can be refiled and reaffirms landlords' rights to reclaim property for genuine personal or instit
