Shams-Ud-Din V. Salah-Ud-Din and others,
CLC 2020 387 · Balochistan High Court
This case involved a family property dispute between brothers over inherited business and mining assets left by their late father. After their father died in 1992, his properties, including shares in two mining companies, had never been formally divided among the heirs. The matter was referred to a private arbitrator, who issued an award in April 2019. One brother, the petitioner, then asked a civil court to confirm this award as an official court order and also sought a temporary injunction to maintain status quo over a house he was occupying.
The trial court initially granted the injunction, ordering the parties to preserve the existing situation regarding the house. However, on appeal, the Additional District Judge overturned that order. The petitioner then challenged this reversal before the Balochistan High Court.
The High Court upheld the appellate court's decision and dismissed the petition. It explained that courts cannot grant temporary injunctions merely because a party has a prima facie case; they must also weigh whether the balance of convenience and risk of irreparable harm favor the applicant. Since any loss the petitioner might suffer could be compensated financially if he ultimately won the case, it did not qualify as irreparable harm. The court also noted that the case involved complex factual and legal questions, including disputes about who was bound by the arbitration agreement, which required full evidence and trial rather than an injunction at this early stage. This ruling reinforces established principles on when courts should or should not grant temporary injunctions.
