Aziz-Ur-Rehman V. Mst. Bibi Jameela and 2 others,

CLC 2020 380 · Balochistan High Court

This case involved a dispute after a divorce between Aziz-ur-Rehman and his former wife, Mst. Bibi Jameela, over dowry articles, dower money, and maintenance. The wife had sued for recovery of Rs. 300,000 as dower, dowry articles worth Rs. 472,800, and maintenance for the Iddat period. The Family Court ruled in her favor, and this decision was upheld on appeal. The husband then challenged both rulings before the Balochistan High Court.

He argued that the dowry articles had already been returned to his wife through a government official, but he could not produce any receipt or proof of this claim, and the official he presented as a witness did not confirm it either. The court held that since he failed to prove his claim, the wife's version stood. It also noted that wives generally cannot be expected to maintain detailed purchase records or get signed lists of dowry items, so her own statement was sufficient proof.

On the dower amount, since it was admitted that the marriage was never consummated, Islamic law entitles the wife to only half the fixed dower, with the rest returnable to the husband unless he voluntarily gives it up. The court therefore modified the lower courts' decisions by reducing the amount related to dowry articles and adjusting the dower accordingly, while otherwise upholding the decisions. This case clarifies evidentiary standards in dowry disputes and reaffirms dower entitlement rules when a marriage is unconsummated.
