Abdul Khaliq V. Additional District Judge-V, Quetta and another,
CLC 2020 320 · Balochistan High Court
This case involved a father and mother who had divorced after a Muslim marriage, with a daughter from their union. The mother had earlier won a court case for the child's maintenance, and the Family Court fixed the amount at Rs.5,000 per month with a 5% annual increase. Later, she filed a fresh case asking for the maintenance to be further enhanced. The father argued that this new case should not be allowed, claiming it was barred by the legal principle of res judicata, meaning the same issue could not be litigated twice between the same parties. The trial court agreed with him and dismissed the new suit, but on appeal, the Additional District Judge sent the case back for a decision on its merits.
The father then challenged this before the Balochistan High Court. The High Court upheld the appellate court's decision, ruling that the earlier case was only about recovery of maintenance, not about its enhancement, so the two were not the same issue. The court explained that circumstances like a child's growth, inflation, and changing needs can create a fresh basis for seeking increased maintenance, meaning such claims can be filed again without being blocked by res judicata.
This ruling matters because it clarifies that parents are not permanently locked into an initial maintenance amount and can return to Family Courts for increases as a child's needs change over time, ensuring maintenance remains fair and realistic.
