The court also noted that a party seeking constitutional relief must show a clear, undisputed legal right, which was not the case here since ownership itself was contested.
This case reinforces an important legal principle: the High Court's constitutional jurisdiction is not meant to resolve disputed facts or substitute for ordinary civil litigation, especially in property disputes where alternate remedies exist.
یہ معاملہ بلوچستان میں جائیداد کے ایک تنازعے سے متعلق ہے۔ درخواست گزار محمد اسماعیل نے دعویٰ کیا کہ وہ خشکابہ بازیگر نامی زمین کے قانونی طور پر شریک مالک ہیں، جسے بقول ان کے ان کے آباؤ اجداد نے تقریباً ایک سو پچیس برس قبل ایک دوسرے قبیلے سے خریدا تھا، اور یہ معاہدہ فارسی زبان میں تحریر کیا گیا تھا۔ انہوں نے الزام لگایا کہ بعض مدعا علیہان نے غیر قانونی طور پر اس جائیداد میں مداخلت کی، اس پر تعمیراتی سامان ڈال دیا اور حد بندی کی دیوار تعمیر کرنے کی کوشش کی۔ ان کا یہ بھی کہنا تھا کہ مقامی حکام نے بااثر ہونے کی وجہ سے ان کے خلاف کوئی کارروائی نہیں کی۔ انہوں نے ہائی کورٹ سے استدعا کی کہ اس مداخلت کو غیر قانونی قرار دیا جائے اور مدعا علیہان کو حکم دیا جائے کہ وہ اس سے باز رہیں اور سامان ہٹا دیں۔
بلوچستان ہائی کورٹ نے اس درخواست کو میرٹ پر غور کیے بغیر خارج کر دیا۔ معزز جج نے قرار دیا کہ اس مقدمے میں سنگین نوعیت کے حقائق کے تناز
