Abdul Qadeer V. Government of Balochistan through Secretary Public Health Engineering and 2 others,

CLC 2020 1942 · Balochistan High Court

This case was filed by Abdul Qadeer, a farmer, asking the Balochistan High Court to cancel a government tender for installing a water supply scheme near Dalbandin, which he claimed was on agricultural land belonging to him and his forefathers. He wanted the land acquired properly under the Land Acquisition Act before any work was done, arguing the tender was illegal and harmful to local people.

The court did not examine the merits of his complaint. Instead, it focused on whether Abdul Qadeer had the legal right to bring such a petition at all. Under Article 199 of Pakistan's Constitution, only an "aggrieved person" whose own legal or fundamental rights have been affected can approach the High Court. After reviewing the land mutation records submitted with the petition, the judge found that Abdul Qadeer was not listed as the owner of the land in question, nor was his name recorded anywhere in the relevant entries. Since he could not show any personal, legal connection to the property, he did not qualify as an "aggrieved person."

Relying on a Supreme Court precedent, the court held that a valid constitutional petition requires a genuine, justiciable personal right that has been violated - mere concern or indirect interest is not enough. Because Abdul Qadeer failed to establish this, his petition was dismissed outright without going into the actual dispute over the tender or the land.

This case illustrates an important procedural principle: courts will not hear constitutional complaints unless the person filing has a direct, provable legal stake in the matter.
