Dr. M. salah-Ud-Din Mengal and another V. Government of Balochistan through Board of Revenue and 2 others,

CLC 2020 1916 · Balochistan High Court

This case involved a land dispute in Quetta where the government took over property, including a poultry farm business, to build a police station. The landowners sought compensation through a reference filed under Section 18 of the Land Acquisition Act, 1894, before the Collector (Deputy Commissioner). After an award was made, disagreements arose over the compensation amount, with the landowners arguing the land and structures were undervalued and that additional costs owed to them had not been paid. The Deputy Commissioner forwarded their reference to the District Court for adjudication. However, the trial court (Additional District Judge-V, Quetta) dismissed the reference, ruling that it had been filed too late, that is, barred by limitation.

The landowners appealed this dismissal to the Balochistan High Court. The High Court held that the trial court was wrong to dismiss the case on limitation grounds. It explained that under the law, the question of whether a reference was filed within the time limit is something the Collector must decide before forwarding the case to court, not something the court itself can reconsider afterward. Since the Collector had sent the reference to the court without raising any objection about it being late, the issue of limitation was no longer open for the court to examine.

As a result, the High Court allowed the appeal, set aside the trial court's dismissal, and sent the case back for a proper decision on its actual merits, giving both parties a fair opportunity to present their case.
