CLC 2020 1895 · Balochistan High Court

This case involved a dispute over a police officer's estate after his death. His widow obtained a succession certificate identifying herself and her minor son as legal heirs. The deceased's sister and other relatives then challenged this, claiming the minor son was actually adopted and therefore had no right to inherit. The trial court, based on this factual dispute, cancelled the succession certificate and told the parties to go to civil court to resolve the parentage question. The widow's appeal against this was dismissed on limitation grounds, so she approached the Balochistan High Court.

The High Court found that both lower courts had erred. It noted that the boy's parentage as the deceased's son was supported by official records from NADRA and a passport issued by the Ministry of Interior. Under the Qanun-e-Shahadat Order (Pakistan's law of evidence), such official and public documents carry a legal presumption of truth and genuineness unless someone proves otherwise. The relatives had not rebutted this presumption; the court viewed their claim as a fabricated attempt to grab money from a vulnerable widow.

The High Court set aside the orders of both lower courts and restored the original succession certificate in favor of the widow and her son. The case highlights how courts must respect official documentary evidence like NADRA records and passports unless properly disproved, protecting vulnerable heirs from baseless challenges to inheritance rights.
