Habib Adm Limited through General Manager V. Executive Engineer Canal Irrigation Division Hub and another,

CLC 2020 1848 · Balochistan High Court

This case was about a dispute between a company, Habib ADM Limited, and the Canal Irrigation Department over water rates. The company had built a new pipeline to supply water to its plant and claimed that officials had assured it the water charge would stay fixed at Rs.11 per unit. When the department later raised the rate several times, eventually to Rs.73 per unit, the company sued, arguing the increase was unjustified and unlawful, and asked the court to cancel the enhanced bills.

Both the trial court and the first appellate court rejected the company's claim, finding no proof that any binding promise had been made to keep the rate fixed forever. The company then filed a second appeal before the Balochistan High Court.

The High Court upheld the lower courts' decisions. It held that the company failed to produce any document proving the alleged assurance of a permanent rate, and that under the relevant law (the Balochistan Canal and Drainage Ordinance, 1980), water supplied without a written contract is subject to prescribed rates set by the authorities. The court also noted that in a second appeal, it cannot disturb concurrent factual findings of lower courts unless there is a clear legal or procedural error, which was not shown here.

The case highlights that government bodies can revise utility rates in the absence of a formal contract, and that courts give strong weight to consistent factual findings from earlier courts.
