Dr. Muhammad Jamal and another V. Sultan Muhammad,
CLC 2020 1716 · Balochistan High Court
This case arose from a property dispute where a plaintiff sued for possession through pre-emption, claiming a right to purchase adjacent land that had been sold without informing him, as required under pre-emption law. During the trial, the plaintiff had already introduced a revenue official as a witness who produced land records as evidence. Later, the plaintiff filed another application asking to bring the very same document onto the record again and re-examine the witness. The trial court allowed this request, and the defendants challenged that decision before the Balochistan High Court.
The High Court ruled in favor of the defendants, holding that once a document has already been placed on the court record, it cannot be introduced again simply to fix gaps or weaknesses that emerged during cross-examination. The purpose of re-examining a witness is only to clarify genuine confusion created by cross-examination, not to give a party a second chance to strengthen or improve their case. The court found that the trial judge had made a legal error by permitting the same document to be produced again without valid justification.
The High Court set aside the trial court's order and sent the case back for the trial court to proceed and decide the matter properly within two months. The judgment reinforces an important principle in civil procedure: courts must apply the law correctly and fairly to both sides, and cannot become a tool that lets a party patch up weaknesses in their evidence after the fact.
