CLC 2020 1561 · Balochistan High Court

This case involved a dispute over land in Kalat, Balochistan. A man claimed his grandfather had gifted him nine acres of land through a gift deed dated 1984, and he had been in continuous possession of it. Part of that land, however, was recorded in government records as belonging to the Provincial Government and the Frontier Corps. He sued for a declaration of ownership, a permanent injunction, and cancellation of the government's revenue entries.

The trial court (Qazi Kalat) dismissed his suit, but on appeal, the Majlis-e-Shoora Mastung reversed that decision and ruled in his favor. The government then challenged this appellate decision before the Balochistan High Court.

The High Court sided with the government and restored the trial court's dismissal. It found that the suit was legally flawed because a necessary party, the Secretary of the Board of Revenue, had not been included in the case. More importantly, the alleged gift failed to meet the basic requirements of Islamic law: a valid gift needs an offer, acceptance, and actual delivery of possession. Here, physical possession was never proven to have been transferred. The court also noted a serious contradiction: the grandfather who supposedly made the gift had died in 1983, a year before the gift deed was dated. Additionally, the suit was filed 35 years late without justification.

This case reaffirms that Islamic gift law requires strict compliance with its essential conditions, and that courts must scrutinize the timing and evidence behind claimed property transfers, especially against government-recorded land.
