Muhammad Akram V. Muhammad Khalid,

CLC 2020 1542 · Balochistan High Court

This case was about a landlord-tenant dispute over a shop in Quetta. The landlord, Muhammad Khalid, had rented a shop to tenant Muhammad Akram and later sought to evict him, claiming he genuinely needed the shop for his own personal use—to demolish and rebuild it and start a business, since he could no longer practice law due to illness. The Rent Controller accepted the eviction request and ordered the tenant to vacate. The tenant appealed, arguing among other things that an earlier eviction case on similar grounds had already failed.

The Balochistan High Court dismissed the appeal and upheld the eviction. It clarified that a fresh eviction case is only barred if an earlier case on the same issue was decided on its merits; since the earlier petition had merely been withdrawn (not decided on merits), a new petition was allowed. The court also addressed what happens when a landlord dies during proceedings—ruling that his legal heirs can continue the case, since rights and obligations pass to them and the matter does not end with death.

The court found the landlord's evidence credible and genuine, and held that ownership rights are protected under the Constitution and take precedence over tenancy rights. The tenant was ordered to vacate within two months after paying due rent. The judgment is significant for clarifying procedural rules on repeat eviction cases and continuation of legal proceedings after a party's death.
