Pure Mineral (PVT.) Limited through duly Authorized Attorney V. Province Of Balochistan through Secretary, Mines and Mineral Development Department, Quetta and 2 others,
CLC 2020 152 · Balochistan High Court
This case involved a mining company, Pure Mineral (Pvt.) Limited, which was granted an exploration license in 2011 by Balochistan's Mines and Minerals Department to explore copper, gold, and other minerals in an area of Chaghi district. Just weeks later, the government withdrew the allotment letter, saying it had been issued by mistake. The area was later formally acquired for the Balochistan Copper-Gold Project through an official notification in December 2012. The company challenged this acquisition notification in court, arguing it was illegal and issued without proper authority.
The Balochistan High Court dismissed the petition. It found that the company had never actually been given possession of the land or a prospecting license, and its original three-year license period had already expired without the company applying for an extension. The court held that extending or refusing a license is entirely the government's discretion, so the company had no vested right to the area. Separately, the court noted the company waited more than five years to challenge the 2012 notification, far beyond the normal three-month window for such challenges, and offered no explanation for the delay.
The judgment matters because it reinforces that mining licenses don't create permanent rights unless formalized through possession and proper legal steps, and that people challenging government decisions in court must act promptly or explain serious delays, or risk losing their case regardless of its merits.
