Ghulam Nabi V. Saifullah and others,

CLC 2020 1507 · Balochistan High Court

This case is about a property dispute in Khuzdar, Balochistan, involving competing claims over land whose mutation records had changed over time. Ghulam Nabi filed a fresh suit seeking declaration, correction of revenue entries, cancellation of mutation entries, and a permanent injunction. Some defendants asked the trial court to dismiss the suit on the ground that the same matter had already been litigated and settled between the same parties years earlier, through a compromise decree in 1986 and a further decree in 1998 that was never appealed. The trial court agreed and rejected the new suit, applying the legal principle of res judicata under Section 11 of the Civil Procedure Code, which prevents parties from relitigating issues already decided by a competent court.

Ghulam Nabi challenged this rejection before the Balochistan High Court, arguing he was denied a chance to present evidence and that factual disputes needed a full trial. The High Court disagreed, finding that the earlier litigation between the same parties over the same subject matter had already conclusively settled the dispute, and allowing a new suit would unfairly force the parties to fight the same battle twice. The court also clarified a technical procedural point: whether such rejection orders should be challenged by appeal or revision depends on whether a formal decree sheet was drawn up. Finding no merit in the challenge, the High Court dismissed the revision petition, upholding the trial court's decision. The case reinforces how res judicata protects finality of court decisions and prevents repeated litigation over settled matters.
