Government of Balochistan through Collector Kachhi and another V. Hazar Khan and others,
CLC 2020 1498 · Balochistan High Court
This case involved a land dispute in Kachhi, Balochistan, where a group of plaintiffs sued for declaration, permanent injunction, and correction of revenue records over a piece of land. The trial court decided in favor of the plaintiffs after the government defendants failed to properly pursue their defense and were eventually proceeded against ex parte. The government then tried to appeal, but filed that appeal over three years and eleven months late, without ever submitting an application explaining the delay. The appellate court (Majlis-e-Shoora, Sibi) dismissed the appeal for being time-barred, and the government challenged that dismissal before the Balochistan High Court.
The High Court upheld the dismissal. It explained that the law of limitation exists to protect the rights of the opposing party once a deadline has passed, and that anyone seeking extra time to file an appeal must formally request condonation of delay and give solid reasons for it. Courts do have discretion to excuse delays under Section 5 of the Limitation Act, but this discretion must be used carefully and cannot be granted automatically. Importantly, the court stressed that government agencies are not entitled to special treatment in matters of limitation and must follow the same strict rules as private citizens. Since the government failed to explain even a single day of the lengthy delay, the court ruled that the appeal was rightly rejected, reinforcing that limitation laws must be strictly enforced regardless of who the litigant is.

ہائی کورٹ نے اپیل کی خارجگی کے فیصلے کو برقرار رکھا۔ عدالت نے وضاحت کی کہ قانونِ حدِ می
