CLC 2020 1458 · Balochistan High Court

This case involved a property dispute where the petitioners had filed a civil suit seeking declaration, possession, mesne profits, and a permanent injunction against the respondents. The respondents contested the suit and applied to have it rejected under Order VII, Rule 11 of the Civil Procedure Code, a legal provision allowing plaints to be thrown out at an early stage without full trial if they suffer from specific defects, such as failing to disclose a cause of action or being legally barred.

During the proceedings, a local commissioner was appointed to visit the disputed land and submit a report. Based largely on this report, the trial court rejected the plaint. The petitioners appealed, but the appellate court dismissed their appeal on the technical ground that it was filed a day or two late.

The Balochistan High Court found both lower court decisions flawed. It held that rejecting a plaint under Order VII, Rule 11 requires courts to examine only the plaint itself at face value, not external reports like that of a local commissioner. If a report is used, the commissioner must be formally examined and both parties must get a chance to cross-examine before it forms the basis of any decision. The court also criticized the appellate court for dismissing the case on a minor delay rather than deciding it on merits, emphasizing that technicalities should not obstruct justice.

The High Court accepted the revision petition, set aside both lower court orders, and sent the case back to the trial court to properly frame issues, allow evidence from both sides, and decide the matter on its actual merits.
